1.1 These Rules on Purchasing Public Transport Tickets (hereinafter called as the “Rules”) is a legal agreement between UAB “Intelligent Communications”, company code 300882953, address of registered office Rinktinės str. 5, Vilnius, Lithuania (hereinafter called as the “Company”), as the administrator of the multi-platform Trafi (hereinafter called as “Trafi”), and you as the user of Trafi, governing purchasing public transport tickets form the Company or ME “Susisiekimo paslaugos” using Trafi app.
1.2 You hereby agree that, before you purchase public transport tickets, you read and agree to all the conditions of these Rules and approve to be legally bound by them.
1.3 Your consent to the present Terms is the conclusion of the agreement. Upon consenting to the present Terms, you must comply with the provisions of the Terms and annexes thereto. In case you do not consent to the present Terms or any part thereof, you shall not be purchase public transport tickets using Trafi.
1.4 Rules may be amended in accordance with relevant decisions of the director of the ME “Susisiekimo paslaugos”. Rules may be unilaterally amended at any time and announcing the amendments on Trafi. The amendment enters into force upon posting. If you continue using Trafi services related to public transport services after the amendment of the Rules, it shall be deemed that you agree with the amendments of the Rules.
1.5 To buy, activate and use public transport tickets via Trafi, you need to enable mobile data in your mobile phone or Wi-Fi.
1.6 Company in any ways does not organizes nor manages public transport activities and is not responsible for the sale, smooth operation, distribution, maintenance or other public transport activities of public transport and tickets.
1.7 Considering that mobile data is necessary for the operation of Trafi, it uses the data, which is charged in accordance with user's mobile operator rates.
2.2 To purchase tickets using the Trafi app, it is mandatory to create an account in the Trafi app and confirm the validity of your account by entering the code specified in the SMS message, which you will receive to the phone number specified in the Trafi app, once. It is noted that the service works for Lithuanian and foreign telephone numbers.
2.3 You must keep accurate, complete, and up-to-date information in your account. Failure to keep accurate, complete and up-to-date information, including the indication of improper or invalid means of payment, may prevent the purchase public transport tickets and other services offered by Trafi. You shall be responsible for any activity that takes place using your account and you agree to maintain security of your account and the confidentiality of your username and password in all cases.
2.4 In case you are a user of “m.ticket” app, you may connect your account and purchase public transport tickets directly from the ME “Susisiekimo paslaugos”. In this case the Company only displays public transport ticket distribution services provided by the ME “Susisiekimo paslaugos” and you purchase public transport tickets directly from the ME “Susisiekimo paslaugos”. All data that you submit during the purchase procedure are submitted directly to the ME “Susisiekimo paslaugos”. The Company only collects statistical data, necessary technical and analytical information, related to actions performed on Trafi and usage of the ME “Susisiekimo paslaugos” services.
2.5 You may purchase and activate few public transport tickets at once. In case you purchase tickets for other person, this ticket shall be valid for that person.
2.6 You can connect your Trafi app’s account to several devices, but the ticket which is activated in Trafi app will be tied to the device in which the ticket was activated, i.e. if you activate the ticket in one device you will be able to use it only from this particular device. For example, if you have activated your monthly ticket on one device and change the device, then your monthly ticket will not be valid on the new device until the Company's employees, upon request from you, mechanically transfer your ticket to the new device. In this situation, when you want the ticket to be transferred to a new device, please contact us by e-mail firstname.lastname@example.org. The Company emphasizes that transferring a ticket from one device to another can take up to 3 business days. Trafi will not be held responsible and will not reimburse for days when you were unable to use the purchased and activated in the previous device ticket from a new device.
2.7 You are solely responsible that the person, who uses your account, will act according to these Rules, other rules presented in Trafi and rules, policies and conditions presented by ME“Susisiekimo paslaugos”, as well as highest ethical standards.
2.8 Vilnius city public transport ticket types and prices are determined by the decision of the Vilnius City Municipality Council. The privileges of traveling by public transport are determined in the Law on Transport Privileges of the Republic of Lithuania. The procedure for transportation by public transport in Vilnius, the obligations of the carrier, driver, passengers, passengers, liability of passengers, passengers' rights and control are established by the decision of the Vilnius City Municipality Council in the Regulations for the carriage of passengers and luggage by buses and trolleybuses in Vilnius.
2.10 The user of Trafi (you) commit to pay all relevant taxed related to purchase of tickets and activations (for example, payment orders set by a bank or another payment agent) to the account generated by the Company.
2.The Company has a right to withdraw money from the bank account you submitted in Trafi later then the day of purchase, as well as to withdraw money once after several purchases. The said withdrawal shall be considered appropriate for your settlement with the Company.
2.12The fee for the Services shall include the payment commission, including service fees / commissions of credit cards Visa / MasterCard or other fees. The amount of the payment for the public transport tickets shall be given in the relevant purchase section of Trafi.
2.13 The Company shall be paid 0.03% (three hundredths) in penalty on the amount not paid in due time, for each day of the delayed payment.
2.14 The Company shall be responsible for the availability of the function of credit card payment and shall provide the card holders with assistance in solving the arising problems. Disputes relating to credit cards shall be settled through mediation by the Company. The Company shall also execute repayment of money and reimburse for the services ordered using the Trafi account (see Trafi Terms and Conditions). If you have any questions, problems or uncertainties regarding credit card payments through your Trafi account or if you wish to take advantage of the right to a refund and cancellation compensation, you can contact the Company's helpdesk by e-mail to email@example.com or via the Trafi internal messaging system. The Company will try to resolve the issue within three business days.
3.1 When activating a Ticket in Trafi, the ticket activation period is applied, which you must evaluate to ensure that the ticket is properly and timely activated, i.e. a public transport ticket shall be active from the moment you enter the public transport and remain active until you exit the public transport.
3.2 A time gap while a public transport ticket is being activated, the ticket is not valid. Public transport tickets are valid from the moment you see “active” sign in the Trafi app.
3.3 You shall purchase the public transport ticket before entering into the public transport and act according to the terms and/or conditions of the ME “Susisiekimo paslaugos” related to usage of the public transport services.
3.4 If you cannot buy and (or) activate a public transport ticket in the Trafi app, you shall buy a ticket in other
ways (for example, from the driver).
3.5 You are liable for selection of suitable type of ticket, activation of the ticket (taking into consideration
activation period), proper presentation of the ticket to a passenger control and other data you submit or
3.6 A not-activated (unused) ticket may be refunded within 14 (fourteen) calendar days from the date of
purchase of the ticket.
3.6.1 In case you purchased a public transport ticket directly from the Company, you may contact the Company by email firstname.lastname@example.org or contacting it via Trafi.
3.6.2 In case you purchased a public transport ticket from ME “Susisiekimo paslaugos”, you may connect to the customer self-service website at https://mano.m-transportas.lt.
3.7 The money for the returned ticket within 14 (fourteen) calendar days after the return procedure is performed will be transferred to the bank account from which the payment for the ticket was made.
4.2 In case you purchase public transport tickets from the ME “Susisiekimo paslaugos”. The Company only displays public transport ticket distribution services provided by the ME “Susisiekimo paslaugos”. All data that you submit during the purchase procedure are submitted directly to the ME “Susisiekimo paslaugos”. The Company only collects statistical data, necessary technical and analytical information, related to actions performed on Trafi and usage of the ME “Susisiekimo paslaugos” services.
4.2.1 For selling (distributing) and accounting for travel by local (city) regular public transport tickets, the ME “Susisiekimo paslaugos” collects and otherwise processes the following data:
- mobile phone number;
- tickets purchased;
- statuses of the tickets;
- activization time of the ticket;
- time of passenger check by a passenger control;
- name and surname;
- bank account number;
- location data using GPS system.
4.3 The ticket purchased via Trafi is connected to your mobile phone number.
4.4 The data collected using Trafi app is stored for 3 (three) years.
4.5 The data collected via Trafi is processed in accordance with the, rules of the Company, laws the Republic of Lithuania and the European Union.
5.1 The Company shall be entitled to unilaterally assign all rights and obligations arising from these Rules to any third party by informing you about it via the Trafi internal messaging system or by e-mail.
5.2 These Rules shall be deemed to be an agreement between you and the Company, which shall be deemed to have been concluded and become effective from the moment you have consented to the Rules.
5.3 Any dispute, disagreement or claim arising out of the Rules or relating to these Rules, violation and / or validity thereof, must first be resolved by negotiation. Upon the failure to reach an agreement through negotiations within 20 (twenty) days from the date of receipt of a written call for negotiations, the dispute, disagreement or claim shall be settled by the court of the Republic of Lithuania according to the place of the Company's registered office (contractual jurisdiction).
5.4 Formation, enforcement, termination, construction of the Rules and settlement of disputes shall be subject to the law of the Republic of Lithuania.
5.5 The conditions specified in these Rules may be changed unilaterally by the Company, by informing you about their amendment (the amended Rules shall be published by Trafi). For this reason, it is recommended that you familiarized yourself with the Rules before the start of each purchase of public transport tickets. If you purchase public transport tickets after the amendment of these Rules, you shall be deemed to have consented to the conditions of the Rules as amended.
